Comscore is aware of Nielsen's September 25, 2017 injunction filing, which merely repeats the allegations made in its earlier filings with the Court and in arbitration. Nielsen continues to mischaracterize Comscore's Extended TV product and the issues raised with the FTC monitor, as well as the FTC's role in permitting Comscore's use of Nielsen's data. Comscore's use of any Nielsen information in its Extended TV product is permitted and falls within the license agreement between the parties. Comscore will vigorously defend these actions and the use of the Extended TV product in the Courts and in arbitration, and expects this matter to be resolved in an expedited manner using agreed-upon arbitration procedures.
